Education Identity Platform Terms of Use / Privacy Policy
Note: the "Company" refers to Sequential Systems Ltd, the creators of the Education Identity Platform
Note: the terms "didbook" or "the platform" or "product" refers to all products and services accessed through an Education Identity Platform User Account and provided by Sequential Systems Ltd - which includes the products The Mondrian Wall, Progress, Teacher Portfolio and didbook itself.
YOUR USE OF the platform IS CONSIDERED TO BE ACCEPTANCE OF THESE TERMS AND CONDITIONS OF USE. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, PLEASE DO NOT USE the platform.
Students
- didbook is designed to help you develop your Education Identity - a formal and holistic representation of what you've achieved, what you are doing now and what you aspire to achieve in the future.
- The personal information your school enters into didbook is used to create your didbook account and allow didbook and your school to provide support and assistance in developing your Education Identity.

Your didbook account is created and managed by your school on your behalf.
You are responsible for choosing appropriate passwords and keeping them safe. didbook is responsible for taking appropriate precautions to protect your password. - By using didbook you agree to using it for the purpose of developing your Education Identity and no other purpose. By using didbook you agree not to upload or enter unlawful, inappropriate or offensive information. Sequential Systems Ltd is not liable for any damage caused by your personal information entered into didbook or for the content you create. You agree not to let other people log in to your didbook account and to not log in to anyone else's didbook account.
- Screenshots and video footage of didbook remain the intellectual property of Sequential Systems Ltd. (creators and owners of didbook). You agree not to publish (web / intranet / print / video), broadcast or otherwise disseminate any screenshots or video footage of didbook or Improvement Centre resources without prior written permission.
- If you believe that your didbook account has been accessed you must let a teacher at your school know straight away.
- Personal information about you is used by your school to create your didbook account. Your personal information and didbook entries are controlled by your school - didbook processes this information on their behalf.
- If you believe that any of your personal information is incorrect you should notify a member of staff at your school who will be able to make any necessary corrections. To provide on-going support, development and improvement of didbook, we may copy and access your personal information and didbook entries. We will not share any information with any third parties without pior written instruction of your school.
- By using and creating content in didbook (usually, but not limited to didbook entries) you are agreeing to transfer the ownership of the content you enter into didbook to your school. You are also agreeing to allow didbook rights to access and use your entries for the purposes of developing and improving didbook, supporting your school and supporting the development of your Education Identity.
Staff
The terms of use as outlined above for students also apply to your use of didbook in addition to the following terms:
- didbook is designed to help you develop the Education Identity of students and staff in your school. Education Identity is a formal and holistic representation of achievements, current activities and future aspirations.
- By using didbook you agree to the Terms and Conditions for using didbook resources - as set out in Terms and Conditions in the didbook Improvement Centre.
- Screenshots and video footage of didbook remain the intellectual property of Sequential Systems Ltd. (creators and owners of didbook). You agree not to publish (web / intranet / print / video), broadcast or otherwise disseminate any screenshots or video footage of didbook or Improvement Centre resources without prior written permission.
- By using didbook you agree to conform to your school's legal obligations and responsibilities under the Data Protection Act 1998 and agree to the didbook data policy as set out in the Data Policy - for School leaders and Staff notice in the didbook Improvement Centre.
- As part of your school's "e-safety" policies and in the course of using didbook, you agree to provide, where necessary, appropriate guidance and clarification on appropriate use of didbook and related data policy to your staff, students and their parents. This may include (but is not limited to) directing them to this information.
- You agree to only create didbook user accounts for people who are either directly employed by or who are full time students at your school.

If a student informs you that they believe their didbook account has been compromised you must immediately disable
the affected accounts and reset the associated passwords.
Please also report the incident to us.
Note: if you are not a didbook Champion or Administrator you will not have permission to edit and disable didbook accounts - please contact a didbook Champion or Administrator to take the necessary action.
Parents & carers
The terms of use as outlined above for students also apply to your use of didbook in addition to the following terms:
- Your school uses didbook for the purpose of developing the Education Identity of your child and others within the school. Education Identity is a formal and holistic representation of achievements, current activities and future aspirations.
- didbook is not a social network - it is a safe and private network within your school in which your child can safely develop their Education Identity. Your child's Education Identity is a formal view of who they are – that can be accessed by all staff in your child's school. As such it is not appropriate for your child to enter sensitive or personal information into their didbook. Combined with an understanding of the implications for posting material on the internet in general, didbook provides schools with a safe environment to help students engage with notions of their online identity, online internet use and the idea of their formal, Education Identity.
- Your school enters and controls some personal information (such as their name, login school email address, class and group information) to didbook to create your child's didbook account and help develop their Education Identity. This personal information entered is the minimum amount of information required to create didbook accounts and allow staff members to use didbook effectively.
- Your child manages parts of their didbook account (such as the password) and creates didbook entries. In using didbook your child transfers rights of use, copyright and access of their entries to the school - which enables the school to help develop the Education Identity of your child and others in the school.
- Your school controls your child's didbook information. For the purpose of supporting the school and students in developing Education Identity, didbook may store, copy and access this information, as instructed by your school and consistent with data protection law.
- Your child will only receive advice and comments in didbook from people directly authorised by your school. No person from didbook or any third party company associated with didbook will directly contact your child without authorisation from your school. Automated password reset link emails and notifications relating to technical information and account usage will only be sent from our anonymous "service@didbook.com" email address.
- We have supplied your school with detailed information relating to our data policies to ensure that they are consistent with their own policies and responsibilities.
- Your school's data policies ensures that any personal information about your child entered into didbook is used appropriately and for the purposes set out here. Sequential Systems Ltd will not share personal information with any third party without written instruction from your school.
- Your school controls who has access to your child's didbook information and will only allow access to appropriate people following their data protection policies and obligations under data protection law.

Additional information
Indemnity.
You agree to indemnify and hold Sequential Systems Ltd, its subsidiaries, affiliates, officers, agents, employees, advertisers and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including legal and other professional fees) arising from or in any way related to any third party claims relating to your use of any of the Service, any violation of these Terms of Service or any other actions connected with your use of the Service (including all actions taken under your account). In the event of such claim, we will provide notice of the claim, suit or action to the contact information we have for the account, provided that any failure to deliver such notice to you shall not eliminate or reduce your indemnification obligation hereunder.
Limitation of Liability.
To the maximum extent permitted by law, the Service Is Available “As Is.”
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
- Your use of the product is at your sole risk. The service is provided on an "as is" and "as available" basis.
- To the maximum extent permitted by law, the Company expressly disclaims all warranties and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.
- The Company does not warrant that (i) the service will meet all of your requirements; (ii) the service will be uninterrupted, timely, secure, or error-free; or (iii) all errors in the software or service will be corrected.
- Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk, and you are solely responsible for any damage to your computer or other device or loss of data that results from the download or use of any such material.
- NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM Sequential Systems Ltd OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS OF SERVICE.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT Sequential Systems Ltd, ITS SUBSIDIARIES, AFFILIATES AND LICENSORS, AND OUR AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, AGENTS AND SUCCESSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, COVER OR OTHER INTANGIBLE LOSSES (EVEN IF Sequential Systems Ltd HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM:
- THE USE OR THE INABILITY TO USE THE SERVICE;
- THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, PRODUCTS, DATA, INFORMATION OR SERVICE PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE;
- UNAUTHORIZED ACCESS TO OR THE LOSS, CORRUPTION OR ALTERATION OF YOUR TRANSMISSIONS, CONTENT OR DATA;
- STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON OR USING THE SERVICE, OR PROVIDING ANY SERVICES RELATED TO THE OPERATION OF THE SERVICE;
- Sequential Systems Ltd's ACTIONS OR OMISSIONS IN RELIANCE UPON YOUR ACCOUNT INFORMATION AND ANY CHANGES THERETO OR NOTICES RECEIVED THEREFROM;
- YOUR FAILURE TO PROTECT THE CONFIDENTIALITY OF ANY PASSWORDS OR ACCESS RIGHTS TO YOUR ACCOUNT INFORMATION;
- THE ACTS OR OMISSIONS OF ANY THIRD PARTY USING OR INTEGRATING WITH THE SERVICE;
- ANY THIRD-PARTY PROVIDED CONTENT OR USE OF ANY OTHER THIRD-PARTY PRODUCT OR SERVICE;
- HE TERMINATION OF YOUR ACCOUNT IN ACCORDANCE WITH THE TERMS OF THESE TERMS OF SERVICE; OR
- ANY OTHER MATTER RELATING TO THE SERVICE.
Exclusions and Limitations.
NOTHING IN THESE TERMS OF USE (INCLUDING THE LIMITATION OF LIABILITY PROVISIONS) IS INTENDED TO EXCLUDE OR LIMIT ANY CONDITION, WARRANTY,
RIGHT OR LIABILITY WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS OR THE LIMITATION
OR EXCLUSION OF LIABILITY FOR LOSS OR DAMAGE CAUSED BY WILLFUL ACTS, NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF IMPLIED TERMS,
OR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, ONLY THOSE LIABILITY AND OTHER LIMITATIONS WHICH ARE LAWFUL IN YOUR JURISDICTION (IF ANY)
WILL APPLY TO YOU AND OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Acceptable Use
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

Prohibition against unauthorised access:
you shall not attempt to gain unauthorised access to the system or engage in any activity that disrupts, interferes with, or harms the system or its users. -
Prohibition against hacking:
you shall not engage in any activity that attempts to breach, test, or exploit the security or vulnerabilities of the system or its users. -
Prohibition against penetration testing:
you shall not conduct penetration testing or any other type of security testing on the system without prior written consent from the company. -
Prohibition against reverse engineering:
you shall not reverse engineer, decompile, or disassemble the system or any part of it. -
Notification of security vulnerabilities:
if you discover any security vulnerabilities in the system, you must immediately notify the company and refrain from disclosing or exploiting the vulnerability. -
Consequences of violation:
any violation of these clauses may result in immediate termination of your user account and legal action if necessary.
